1. Acceptance of Terms
By accessing or using tolkachev.net (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Site or purchase any product or service through it.
We may update these Terms from time to time. The current version will be posted on this page. Your continued use of the Site after changes are posted means you accept the revised Terms, except where applicable law requires a different form of notice or consent.
2. Description of the Site
tolkachev.net is the personal website of Sergey Tolkachev, operated by Evolution AI LLC. The Site publishes personal and business content, including articles, life updates, business commentary, investing commentary, AI-related posts, and personal experience materials.
The Site may offer:
- A paid digital book, "Startup: Your Path to a Million" / English edition (the "Book");
- Free downloadable guides, including guides about passive income via ETFs, renting a car abroad, and setting up an AI agent (the "Guides"); and
- A one-hour paid conversation with Sergey Tolkachev, described as "Consultation with Sergey" or "A Conversation With Me" (the "Consultation").
The Site does not currently provide user accounts, comments, forums, or other user-generated-content areas.
3. Eligibility
The Site and its products are intended for users who are at least 18 years old, or the age of majority in their jurisdiction, whichever is higher. By using the Site or purchasing any product or service, you represent that you meet this requirement and have legal capacity to enter into these Terms.
4. Intellectual property
All content on the Site, including text, articles, images, graphics, the Book, the Guides, and other downloadable materials, is owned by Evolution AI LLC or Sergey Tolkachev, or used with permission, and is protected by copyright and other intellectual-property laws.
You may view and read Site content for personal, non-commercial use only. You may not copy, reproduce, distribute, resell, publicly share, post online, create derivative works from, scrape, train AI models on, or otherwise exploit Site content, the Book, or the Guides without prior written permission, except as expressly allowed by these Terms or by applicable law.
5. Digital products — Book and Guides
5.1 License. Upon purchase of the Book, or download of a free Guide, you receive a personal, limited, non-exclusive, non-transferable, revocable license to use the file for your own personal reading and educational use. You may not resell, redistribute, publicly share, post, upload, sublicense, or otherwise make the file available to others.
5.2 Delivery. The Book is delivered via a download link provided after payment. Free Guides are available via direct download link. You are responsible for downloading and saving the file after access is provided. If a download link does not work, contact us through the contact form at https://tolkachev.net/contact/ and include your Stripe receipt or order reference.
5.3 No professional advice. The Book and Guides reflect personal experience, opinions, and general knowledge. They are provided for informational and educational purposes only and do not constitute financial, investment, legal, tax, accounting, immigration, medical, or other professional advice.
5.4 No guarantees. The Book, Guides, and Site content may describe personal experiences, examples, opinions, strategies, or results. They do not guarantee any financial outcome, business result, immigration result, investment performance, income level, or other specific result.
6. Paid consultation ("A Conversation With Me")
6.1 Nature of the service. The Consultation is a one-hour personal conversation in which Sergey Tolkachev shares his own experience regarding topics that may include business, investing, immigration, technology, AI, and personal development. It is a discussion of personal experience and general information, not a professional advisory service.
6.2 No advisory relationship. The Consultation does not constitute:
- Financial, investment, tax, accounting, or retirement advice or planning;
- Legal advice, immigration advice, legal representation, or document preparation as an attorney;
- Medical, psychological, or other regulated professional service; or
- A promise to solve a business, financial, immigration, legal, or technical problem.
No advisor-client, broker-client, accountant-client, attorney-client, fiduciary, or other professional relationship is created by booking or attending a Consultation.
6.3 No registered advisor status. Sergey Tolkachev is not acting as a registered investment adviser, broker-dealer, attorney, accountant, tax professional, immigration adviser, or licensed financial professional. Nothing on the Site, in the Book or Guides, or during a Consultation is a recommendation or offer to buy, sell, or hold any security, cryptocurrency, financial product, business interest, or other investment.
6.4 Your decisions are your own. Any decisions you make based on the Site, Book, Guides, or Consultation are made at your own discretion and risk. You should consult appropriately licensed professionals for investment, legal, tax, accounting, immigration, medical, or other regulated matters.
6.5 Scheduling. Consultations are booked through Cal.com or another third-party scheduling tool after payment is completed. The scheduling link is provided on the post-payment confirmation page and is intended only for the purchaser's personal use. You may not transfer, resell, or share your Consultation booking without our prior written permission.
6.6 Rescheduling and cancellation. Rescheduling, cancellations, no-shows, and refunds are governed by the Refund Policy, which is incorporated into these Terms by reference.
6.7 Conduct. We may refuse, end, or decline to reschedule a Consultation if a participant is abusive, threatening, fraudulent, violates these Terms, or uses the Consultation for unlawful purposes. In such cases, refunds are handled according to the Refund Policy and applicable law.
7. General disclaimer
All content on the Site, in the Book, in the Guides, and in the Consultation reflects personal opinions and experience. It is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, non-infringement, availability, or uninterrupted access.
Past results, examples, stories, or experiences described on the Site or in any product or Consultation are not guarantees of future results.
Some jurisdictions do not allow certain warranty exclusions, so some of the above exclusions may not apply to you. Nothing in these Terms limits rights that cannot be limited under applicable law.
8. Payments
Payments for the Book and Consultation are processed by Stripe, a third-party payment processor. We do not collect or store your payment-card details; they are handled directly by Stripe under Stripe's own terms and privacy policy. Prices are listed in U.S. dollars unless stated otherwise.
You are responsible for any taxes, duties, currency conversion charges, bank fees, or similar charges that may apply to your purchase, except to the extent Stripe or another payment processor collects such amounts at checkout.
9. Refunds
Refunds, rescheduling, cancellations, no-shows, and access issues are governed by our Refund Policy, available at https://tolkachev.net/legal/refund/, which is incorporated into these Terms by reference.

11. Third-party links and services
The Site may link to third-party websites or use third-party services, including Stripe for payment processing, Cal.com for scheduling, Cloudflare Turnstile for spam prevention, Amazon Web Services for hosting/infrastructure, and other operational providers.
We are not responsible for the content, policies, availability, security, or practices of third-party websites or services. Your use of third-party services is subject to their own terms and privacy policies.
12. Limitation of liability
To the maximum extent permitted by law, Evolution AI LLC, Sergey Tolkachev, and their owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, business opportunity, data, goodwill, or other intangible losses, arising from or related to your use of the Site, the Book, the Guides, or the Consultation, even if advised of the possibility of such damages.
To the maximum extent permitted by law, our total liability for any claim arising from or related to these Terms, the Site, the Book, the Guides, the Consultation, or any purchase will not exceed the amount you paid to us for the specific product or service giving rise to the claim in the twelve (12) months before the claim arose.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
13. Indemnification
You agree to indemnify and hold harmless Evolution AI LLC, Sergey Tolkachev, and their owners, officers, employees, contractors, and agents from and against claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your misuse of the Site, violation of these Terms, violation of another person's rights, or unlawful conduct.
14. Governing law and venue
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in your jurisdiction require otherwise.
To the extent permitted by applicable law, any dispute arising from or related to these Terms, the Site, the Book, the Guides, the Consultation, or any purchase will be brought exclusively in the state or federal courts located in Florida, and you consent to personal jurisdiction and venue in those courts.
15. Changes to these Terms
We may revise these Terms at any time by posting an updated version on this page. Material changes will be indicated by an updated "Last updated" date. The version in effect when you make a purchase generally governs that purchase, unless a change is required by law or you expressly agree to revised terms.
16. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision will be interpreted or replaced to the extent necessary to make it enforceable while preserving its original intent as closely as possible.
